Terms of Service

These Terms of Service ("Terms") govern your access to and use of the AnchorKite website at anchorkite.com (the "Site"). The Site is operated by AnchorKite LLC ("AnchorKite," "we," "us," or "our"), a limited liability company organized under the laws of the State of Georgia, United States.
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
These Terms apply to the Site only. Individual apps published by AnchorKite (such as Attenda) are governed by their own terms of service or end user license agreement, which you'll find on the app's store listing or within the app itself.
1. Use of the Site
You may access and use the Site for personal, non-commercial purposes consistent with these Terms. You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorized access to any portion of the Site, our servers, or systems connected to the Site
- Interfere with or disrupt the Site, including by introducing viruses, malware, or other harmful code
- Use automated means (such as bots, scrapers, or spiders) to access or collect content from the Site, except for well-behaved search engine crawlers respecting our
robots.txt - Reproduce, duplicate, copy, sell, resell, or otherwise commercially exploit any portion of the Site without our prior written consent
- Use the Site to harass, abuse, defame, or harm any person or entity
- Reverse engineer, decompile, or attempt to extract source code from the Site
We reserve the right to suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms.
2. Intellectual property
All content on the Site — including text, graphics, logos, images, the AnchorKite name and mark, design elements, layout, and code — is owned by AnchorKite LLC or our licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, publicly display, publicly perform, republish, or create derivative works based on Site content without our prior written permission, except that you may:
- View the Site in a browser for personal, non-commercial use
- Print or save reasonable portions for your personal reference
- Share links to the Site on social media or in private communications
The AnchorKite name, logo, and brand elements are trademarks of AnchorKite LLC. You may not use them in a way that suggests affiliation, sponsorship, or endorsement without our written permission.
3. Third-party content and links
The Site may contain links to third-party websites, services, or resources we do not operate or control. These links are provided for convenience only. We do not endorse and are not responsible for the content, accuracy, privacy practices, or availability of any third-party site or service. Use of third-party sites is at your own risk and subject to their own terms.
4. AnchorKite apps
References on the Site to AnchorKite's apps (including Attenda) are informational. Use of any AnchorKite app is governed by that app's separate terms of service or end user license agreement and privacy policy, available within the app or on its store listing. Nothing on this Site constitutes an offer to license or sell any app; access to and use of AnchorKite apps is granted only under the applicable app-specific terms.
5. Disclaimer of warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ANCHORKITE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that defects will be corrected. We make no warranties about the accuracy, reliability, completeness, or timeliness of content on the Site.
Some jurisdictions do not allow the exclusion of certain warranties. If those laws apply to you, some or all of the disclaimers above may not apply, and you may have additional rights.
6. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ANCHORKITE LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).
Some jurisdictions do not allow the limitation or exclusion of liability for certain damages. If those laws apply to you, some or all of the limitations above may not apply, and our liability will be limited to the greatest extent permitted by law.
7. Indemnification
You agree to indemnify, defend, and hold harmless AnchorKite LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms
- Your use of the Site
- Your violation of any rights of a third party
- Your violation of any applicable law
8. Governing law and jurisdiction
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Georgia, and you consent to the personal jurisdiction of those courts.
If you are accessing the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.
9. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. If we make material changes, we will provide additional notice on the Site. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, your only remedy is to stop using the Site.
10. Severability
If any provision of these Terms is held to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
11. No waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of AnchorKite.
12. Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and AnchorKite regarding the Site and supersede any prior agreements between you and AnchorKite relating to the Site.
