These Terms of Use ("Terms") govern your use of the Codexia mobile app (the "App"), published by AnchorKite LLC ("AnchorKite," "we," "us," or "our"), a limited liability company organized under the laws of the State of Georgia, United States.
By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
These Terms apply to the App only. The website at anchorkite.com is governed by the AnchorKite Terms of Service. How the App handles information is described in the Codexia Privacy Policy.
If you got the App from the Apple App Store, Apple's Licensed Application End User License Agreement also applies. If it conflicts with these Terms, Apple's agreement controls to the extent of the conflict.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own personal, non-commercial use, subject to these Terms and the terms of the store you got it from.
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable law
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse engineer, decompile, or attempt to extract the App's source code, except where the law expressly permits it
- Circumvent or interfere with the App's purchase, trial, or entitlement checks
2. Your library
Your library data is stored only on your device (see the Codexia Privacy Policy). We do not hold a copy and cannot recover it for you. You are responsible for your device and for any exports you make. Uninstalling the App deletes its data.
3. Subscriptions, trials, and the lifetime unlock
Codexia's features require an active subscription or the lifetime unlock.
- Subscriptions. Monthly and yearly subscriptions are billed through Google Play (or, on iOS, the Apple App Store) to the account you use with that store. Subscriptions renew automatically at the end of each period at the then-current price unless you cancel at least 24 hours before the period ends.
- Free trial. New subscribers get a 7-day free trial. If you do not cancel before the trial ends, the subscription starts and you are charged for the first period.
- Cancellation. You cancel and manage subscriptions through your store account (Google Play: Payments & subscriptions; App Store: Settings → your name → Subscriptions), not through AnchorKite. Cancelling stops future renewals; you keep access until the end of the current paid period.
- Lifetime unlock. The lifetime unlock is a one-time purchase that unlocks the App's paid features without a recurring charge. It is non-refundable, except as required by the store's refund policy or by law.
- Refunds. Payments are processed by the store, so refund requests are handled under Google Play's or Apple's refund policies.
- Prices. Prices are shown in the App and in the store before you buy, and may vary by region. We may change prices for future periods; the store will notify you as its policies require.
4. Book information
Book details and cover images come from Open Library (openlibrary.org, run by the Internet Archive), a third-party service we do not control. That information may be incomplete or inaccurate, and Open Library may be unavailable at times. Open Library's own terms apply to its service and content.
5. Intellectual property
The App, including its code, design, and the Codexia and AnchorKite names and marks, is owned by AnchorKite LLC or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights in our names or marks. You own the notes and photos you add to your library.
6. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ANCHORKITE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the App will be uninterrupted or error-free, that defects will be corrected, or that book information from Open Library will be accurate or complete.
Some jurisdictions do not allow the exclusion of certain warranties. If those laws apply to you, some or all of the disclaimers above may not apply, and you may have additional rights.
7. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ANCHORKITE LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100.00).
Some jurisdictions do not allow the limitation or exclusion of liability for certain damages. If those laws apply to you, some or all of the limitations above may not apply, and our liability will be limited to the greatest extent permitted by law.
8. Governing law and jurisdiction
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the App will be resolved exclusively in the state or federal courts located in Georgia, and you consent to the personal jurisdiction of those courts. Nothing in this section removes any mandatory consumer protection rights you have under the laws of the country where you live.
9. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be communicated via the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
10. Severability and no waiver
If any provision of these Terms is held to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of it.
